Freed from custody

Tom, a young indigenous prisoner who was sentenced as a juvenile was released on court-ordered parole. Queensland Corrective Services imposed a range of parole conditions on him, including some that went beyond the standard conditions on a court-ordered parole. These were very onerous and difficult for the prisoner to comply with; on breaching one of these conditions, he was returned to custody and his parole was cancelled.

Prisoner’s Legal Service challenged these decisions. They argued that Queensland Corrective Services did not have the power to impose those additional conditions on the parole order. Queensland Corrective Services subsequently lifted the cancellation of the prisoner’s parole order and removed the additional conditions. He was then released from custody.
